Terms of Service

Members must agree to the following terms to join The Propane Collective:

  1. Membership Details
    Each membership fee covers service to one residential building, plus a generator (if applicable). If you have additional service hookups, such as granny flats, shops, or rentals, a separate membership fee will be required for each.
  2. Membership Term
    The membership fee applies to the remainder of the current calendar year, no matter when your service with InterState Propane begins; membership fees are not pro-rated. Subsequent membership fees will be billed at the start of each new calendar year.
  3. Money-Back Guarantee
    If InterState Propane determines it can’t provide you service when setting up your account, we’ll refund your membership fee in full. Also, if within 60 days of paying your initial membership fee you elect to cancel your membership, we’ll happily refund your membership fee. Your membership fee is non-refundable if you cancel for any reason after 60 days from the date you paid your initial membership fee. Requests for refunds must be submitted in writing (via email is acceptable) within 60 days of your initial membership fee payment. Eligible refunds will be processed by TPC within 10 business days of receipt of your written refund request.
  4. You’ve Read the Terms
    By paying the membership fee, you confirm you’ve read and agree to the terms on our website, including Minimum Usage Requirements & Fees and the pricing and terms detailed on our Member Pricing page.
  5. Our Role
    The Propane Collective LLC (TPC) is not affiliated with InterState Propane and acts solely as an intermediary. Our role is limited to negotiating discounted pricing and terms with InterState Propane (InterState) for our members. TPC and its officers, employees, assigns, and successors in interest are not responsible for any services provided by InterState, including but not limited to propane delivery, account setup and management, credit checks, or any other aspects of your propane service, all of which are subject to the agreement(s) between you and Interstate Propane, to which TPC is not a party or benefited third party.
  6. Pricing Terms and Price Quotes
    Membership in TPC entitles Members to receive special pricing and terms directly from InterState Propane. These terms are detailed on our website and ultimately subject to the agreement Members sign with InterState Propane. As a courtesy, we post current and historical Member pricing on our website. While we make our best attempts to be accurate, mistakes in posted pricing may occur and no guarantees or warranties are made respecting the accuracy of such information. The actual price that is charged to Members will be per the agreement between Member and InterState Propane.
  7. Savings Projections
    Savings estimates vary by Member and are provided along with Price Comparisons on our website for illustration purposes only. Average savings and other calculations are estimates, and no guarantees or warranties are made respecting the accuracy of such information.
  8. Information Sharing & Data Security
    By joining TPC, you authorize the sharing of your account information between TPC and InterState Propane. TPC takes reasonable precautions to protect data received by TPC such as using trusted third-party services. However, TPC is not liable for any data breaches, including, but not limited to, those involving our credit card processing system, membership management software, or any data compromises by InterState. You agree not to hold TPC responsible for any such breaches.
  9. TPC Limited Role, Limitation of Liability, Waiver, & Indemnification
    TPC acts solely as an intermediary between InterState and TPC members. TPC is not liable for or otherwise responsible for any issues arising from services provided or business practices followed by InterState, including but not limited to account management, billing, credit checks, propane delivery, delivery delays, property damage, and service interruptions. You agree to indemnify TPC and have a duty to defend and hold TPC harmless from all claims, disputes, litigation, arbitration, administrative proceedings, judgments, costs and attorneys’ fees arising out of your agreements or use of services with Interstate Propane.

    You on behalf of your predecessors, successors, agents, assigns, and successors in interest, hereby release and forever discharges TPC together with its assigns, officers, agents, employees, representatives, and successors in interest from all claims, charges, complaints, liabilities, damages, rights, demands, costs, losses, debts, penalties, fees, wages, expenses (including attorneys’ fees and costs actually incurred), and punitive damages, of any nature whatsoever, whether at law or in equity which you may have, or may have had, against TPC, or which may hereafter develop, for any acts or omissions related to or arising from this Agreement or the subject of this Agreement, and any other matter between the Parties related in any way to this Agreement or the subject of this Agreement.

  1. Mediation of Disputes and Attorney’s Fees
    In the unlikely event any dispute or claim arises relating to this Agreement, you agree to use best efforts to work together with TPC to resolve the matter informally. In the event the dispute cannot be informally resolved, you and TPC agree to submit to mediation and share the costs of a mediator before instituting legal action. The prevailing party in any litigation shall be entitled to recover reasonable attorneys’ fees and costs incurred in connection with any litigation, however, in the event one of the parties fails to participate in pre-lawsuit mediation, the other party shall be entitled to recover attorneys’ fees and costs, irrespective of whether that party ultimately prevails in the action.
  2. Miscellaneous
    If a court finds any part of this agreement unenforceable, the rest of the agreement remains in effect. This Agreement may be executed by the Parties in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
  3. Interpretation, Severability, and Enforcement
    (a) Interpretation. The headings in this Agreement are purely for convenience and are not to be used as an aid in interpreting its terms.

    (b) Severability. Should any provision of this Agreement be declared or be determined by any court to be illegal, invalid, or unenforceable, the validity of the remaining parts, terms, or provisions shall not be affected thereby and the illegal, invalid, or unenforceable part, term, or provision shall be deemed not to be a part of this Agreement.

    (c) Enforcement. Nothing in this Agreement shall be construed as, or constitute, a release of any Party’s right to enforce the terms of this Agreement.
